The United States Citizenship and Immigration Services (USCIS) has introduced a significant update to facilitate the H-1B visa application process for companies worldwide. Starting from February 28, 2024, USCIS has launched new myUSCIS organizational accounts. This initiative aims to simplify the process for organizations sending employees to the United States by allowing multiple individuals within an organization, along with their legal representatives, to collaboratively manage H-1B registrations, petitions, and any related Form I-907, Request for Premium Processing Service.

To participate in the H-1B Electronic Registration Process for the fiscal year (FY) 2025, organizations are now required to set up a new organizational account. The registration window for the FY 2025 H-1B cap will open at noon Eastern on March 6, 2024, and will close at noon Eastern on March 22, 2024, ensuring a minimum registration period of 14 calendar days as per the annual cycle. This streamlined process mandates that only those with selected registrations will be eligible to file for H-1B cap-subject petitions.
Key Updates and Requirements
One of the notable changes for the FY 2025 registration period is the requirement for registrants to provide valid passport information or a valid travel document for each beneficiary. This requirement is pivotal to ensure that the provided document is intended for use by the beneficiary to enter the United States if they are granted an H-1B visa. It is critical to note that each beneficiary can only be registered under one passport or travel document.
Moreover, USCIS has announced that starting in March 2024, it will introduce online filing for Form I-129 and associated Form I-907 for non-cap H-1B petitions. Following this, on April 1, USCIS will commence accepting online filings for H-1B cap petitions and associated Forms I-907 for petitioners with selected registrations. This move is aimed at enhancing the efficiency of the filing process.
In addressing any potential technical issues, USCIS has also taken steps to ensure a smooth transition for legal representatives whose accounts were migrated as of February 14, 2024. This includes addressing impacts on cases beyond H-1B filings.
Streamlining the H-1B Visa Application Process
The introduction of the electronic registration process and the requirement for organizational accounts represent a strategic effort by USCIS to streamline processing, reduce paperwork, facilitate data exchange, and offer cost savings for employers. The $10 H-1B registration fee per beneficiary remains in place, ensuring that all prospective petitioners, including those eligible for the advanced degree exemption, comply with the electronic registration requirement before filing H-1B cap-subject petitions.
The adjustments to the H-1B visa application process come on the heels of USCIS's announcement in December 2023 that it had received a sufficient number of petitions to meet the congressionally mandated caps for FY 2024. This underscores the high demand for H-1B visas and the importance of a streamlined and efficient process for both employers and beneficiaries.
With these updates, USCIS aims to enhance the H-1B visa application experience, ensuring that the United States continues to attract skilled workers from around the globe in a manner that is both efficient and effective.
